What Should the Realtors Be Fighting For ?

When the Realtor March to Washington, or Throw a Tantrum at the Local Planning Boards they seem to do this in the Name of the Real Estate Consumer, when in Fact this is in NO Way the Case. The Realtors lobby to keep banks out of real estate, the Realtors lobby to make sure they get to Keep on Being Realtors. They Push their "Political Clout" on local government, town councils, and planning boards to force more and more development even when there is too much in a particular area already.

The Realtors talk the states into mandatory E and O insurance laws, the E and O insurance companies, of course, join this battle. Your State Real Estate Governing Bodies, in quite a few states now, Make the E and O insurance Mandatory, KNOWING full well that this E and O insurance that Realtor Have Makes Darn Sure that the Real Estate Consumer Gets absolutely No Justice from the Realtor who Lied to them, Misled them and Failed to Disclose Known Facts or Issues with the Property they bought.

The Realtors have gotten out of control with their "Governing Powers" - they affect communities and push their way on them - they push out discount brokers and push local real estate magazines to NOT allow the For Sale by Owner.

You would think that the Realtors work for the Real Estate Consumer But instead the Real Estate Consumer is FORCED to work with the Realtor and Gets Absolutely No Protection in their Real Estate Transaction. Everybody seems to be fighting and pushing for what is right for the Realtors and Not making any effor to "Lobby" for issue of Realtors Lying to Consumers - Hurting the Real Estate Consumer with Absolutely No Accountability. Local Real Estate Association either can't or won't enforce rules on their Realtor members. the Realtors have to Much money to fight. And quite often the Realtors Make Way more money then those who run the local association, so they had just better stay in line or get sued... It is a vicous cycle and for now the Realtor is Still Well on Top of this Heap of Trouble.

Mandatory E and O Insurance ?

Wouldn't you, as a Real Estate Consumer ,Feel somehow safer and more protected in your real estate transaction if it was Mandatory that your Real Estate Agent, your REALTOR, had E and O Insurance ?


I sure use to think that this was a real good thing. Many states do make it Mandatory that Realtors have E and O insurance. Consumer think that E and O insurance Protects them. I as a Broker Owner used to think that E and O insurance Protected My Real Estate Clients - Customer and Consumers. I was Flat OUT Wrong.

They Lobby to make sure that E and O insurance is mandatory and the E and O insurance providers are right there by the Realtors side, the Real Estate Commission of your state - hand in hand talking about the Consumer Protection benefits of Mandatory E and O insurance. Well the Real Estate Commission, they are home owners, they are consumers, they are parents and children and they want what is best for all those in their state.

They are SOLD on the idea of Mandatory E and O insurance protecting the Real Estate Consumer, and gee won't that be great. However, the E and O insurance Provider turns right around and tell the Realtor, the person working for your supposed best interest in the Real world of Real Estate, that it is NOT the Intention of E and O Insurance to Protect our Real Estate Clients. The Intentions seems to be to protect the Realtors from the Real Estate Consumer.

You know those time consuming lawsuits to pay for your kids medical over undisclosed MOLD issues, or those times you want to sue a Realtor for lying or for non-disclosure that has Life Safety issues and certainly those times when you lose everything because a Realtor Lied to You.

The E and O insurance Makes sure that the Realtor is protected to Go ahead and lie, and though state law may say that a Real Estate Agent Must Disclose all they know, well the Real Estate Attorney hired by the E and O insurance provider can keep you in court so long with all their VERY BIG money that you Give Up, you give in, you let the Realtor go by choice or necessity. They have so much money, especially with the REALTOR franchises behind them, and the NAR behind that - therefore the TRUTH well that is simply irrelevant.

In my home town Realtors Lie, SHOCKING... well ok you knew that but the thing is, they really do get away with deliberate lies and there really is no way to make a REALTOR pay for the damage they do.

SO when your State Makes the REALTORS get E and O insurance, when your State opts in for Mandatory E and O insurance, what they are really saying is that WE will take your real estate license from you unless you Get E and O insurance to Protect you FROM the Real Estate Consumer.

They are really saying that you, the real estate consumer have frivalous complaints against those innocent Realtors and you must be stopped from EVEN trying to hold the Realtor accountable for the lies they tell. More and More states seem to be adopting laws that actually making lying by Realtors legal.

They are saying ... You can't sue the Realtor, you knew going in that they were going to harm you and you Dumb Consumer you, you went ahead and used a Realtor so too bad you lose.

Seriously where will this Real Estate Consumer bashing end, I personally see no end in site. YOU need protection and the only real protection you have is knowledge.

Mandatory E and O insurance forced on Real Estate Agents, Realtor in order to Protect them from you is really a Step too far. And the fact that the E and O insurance provider convinces State Real Estate Lawmakers to create and enforce these laws is a violation of your rights as a consumer and is bad for the real estate consumer in every sense of the word. These actions SHOULD be illegally, they are definately immoral and unethical. Why Do State Real Estate Boards go This far? I mean what do they really gain? Hmmmmm.. So many questions that will never truly be answered.

Real Estate Listings - Lies - and YOU..


How Accurate are Real Estate Listings on Websites?

They are NOT accurate at ALL. The Property could sell before you even see the Listing. Realtors will Keep it on the Site on purpose as Bait to get another buyer. Also if you Put your Real Estate for Sale on Several Online Sites, it is VERY hard to go back and Delete them all and Hey - it's FREE publicity.

I have EVEN seen Realtors put Signs on Property that are NOT for Sale and When Someone Calls they Say it Sold, and they conveniently Find them Something Else.Realtors deliberate enter false or misleading data sometimes, or sometimes don't enter the listing at all to "hoard it". Some say that this is NOT still happening .... IT is..It is IMPOSSIBLE to "Clean Up the 'Realtors" Industry" And I SEE no measures in Place by the National Association of Realtors do Really Even Try.

Ethics are NOT Law and Realtors Don't EVEN follow them, no ONE is looking and even if they do get caught in Lies, they are Self Policed so NO Trouble getting through that one.

Try Harder, take another meaningless Class. Realtors Lie Every Day, Realtors have NO One Looking over their Shoulder. Some think that Brokers watch over Agents "Realtor" Brokers don't care. I once called a managing Broker on a Very Serious deal that ended up in a Seller Losing a Good Deal and a Lot of Money.
The Managing Broker (Realtor) said " I can't help you - I am on the Grievance Committee" - How can a Managing Broker be on a grievance committee ?

Doesn't it Limit them being able to Supervise their "Realtors"? This is ONE example, There are hundreds and most likely thousands, where Realtors, Brokers, DO Not care if agents in their office VIOLATE ethics or Break the Law.

I have called my local MLS office on Violations, information on Fraud, information on inaccurate MLS Data, information on "Realtors" - agents working for more than one office, information on agents lying about Known Defects to the Point of Sellers losing everything, and THEY offered no belief No Support.Realtors are Self Governed.

They decide their own fate, they decide who "gets in trouble" for what, and if any Harm was Really Done and to Whom. You can Just Imagine How that Plays Out.

And if you go to the State Real Estate Commission about a Realtor they wash their hands of it - because they DO NOT have the Money, Lawyers, or Political Power to Stand up to the Local, State or National Association of Realtors. - You Lose.

If you Get an Attorney, a Real Estate Attorney to Fight for You, if you KNOW and Can prove without a Doubt that a Realtor lied or concealed a "Known Defect" - Latent Defect - or Adverse Material Fact" than you will think, as a Real Estate Consumer that you will have Recourse and that Justice Will be Served.

It Will NOT be served.The "National Association of Realtors" and Local Real Estate Boards encourage Realtors and some states Even Mandate Realtors to Have E and O insurance.

They "pretend" that, and convince us Real Estate Brokers and You Real Estate consumers that a "Realtor" having E and O insurance is good for real estate Consumers. It is Simply NOT True. The E and O insurance that YOUR Realtor has is intended to Protect Your Realtor from you.

So even if you Know and Can Prove without a Doubt that Your Realtor Lied about something in, on or around your real estate transaction and you can Really Prove without a doubt how much it Harmed You.

So In this the E and O insurance company will FIGHT YOU for Years, and EVEN though you have Black and White, without a doubt Proof the E and O insurance, the Realtors will Prove that Somehow it was you, the victim of real estate fraud, your fault. They will keep you in court for years, take precious years from your family, you will live in debt and stress because of the Realtors LIE, you Have Proof - and No One Will Care.

And in the End you will most likely Give up, Because the Association of Realtors is Big Business and Protecting the Real Estate Consumer is NOT the Business They are in.

It is Even Worse if the Agent is Century 21, ERA, Coldwell Banker or Sotheby's Because they are ALL owned by the Same Billion Dollar Company and they can FIGHT for a Decade.

The Association of Realtors DOES nothing to Protect YOU the Real Estate Consumer, they are Out to Protect the "Realtors" - all the while claiming you had better not use the Word Realtor to Describe a Profession... this - they say is a Trademark Violation.

The NAR is scrambling to Stay Relevant in the Internet Age and they Are Hurting the Real Estate Consumer in the Process.

E and O insurance Mandate?

Why do some States Mandateor Require that a Realtor has E and O insurance.Does the state, somehow, think that this insuranceprotects the consumer?

Is the State in some sort of collaberationwith the E and O insurance provider or does the State want to Protect the Realtor, because the E and O insurance, by it’s very nature is not designed to protect the consumer.

Some States even threaten disciplinary action
for failure to carry Errors and Omissions (E&O) Insurance.

They even threaten to Suspend the Agent's License if they Fail to Have E and O insurance.

But the Insurance is to Protect the Agent...

So what are we missing here?

Do the State Licensings Boards for Real Estate know that the E and O insurance
does not protect the consumer ? Or are they just REALLY wanting to make sure that Realtor has the Protection they need so that they will not get hurt financially in a real estate transaction?

It is a Mystery to Me, a Real Estate Broker owner who faithfully has had E and O insurance since the moment I opened my own Real Estate office, even though it was not required.

I thought I was going above and beyond to protect my real estate consumer.

Come to Find Out There was NEVER protection
for my Real Estate Consumer
I just Did not Know.
